Generally, we rely on your clear, unequivocal and comprehensible consent as the legal basis for processing your data. This covers cases where you require us to process your data for the purpose of performing a contract with you, or accessing our services. Where the legal basis for processing your personal information is based on consent, we shall ensure that consent is freely given and is obtained following full disclosure of its intended use and without fraud, coercion or undue influence. Since the performance of a contract with you and provision of our services to you are conditional on your consent, we shall deem that you have granted us the free and express consent to collect and process your personal data when you fill any of our forms, or correspond with us by post, phone, email as well as other related medium.

7. Data Breach Management Procedure

 We have in place a data breach procedure to deal with incidents concerning personal information or privacy practices leading to any form of unlawful/unauthorized access or disclosure of personal information transmitted, processed, held and managed by us.

In the event of any data breach, we shall conduct an assessment impact of the breach and shall within 72 hours notify the National Information Technology Agency (NITDA). Where such data breach will likely result in high risks to the freedoms and rights of the data subject, we will immediately notify the affected data subjects. In the case of a potential breach, we shall investigate to determine if an actual breach occurred.

However, TUSEN shall not be responsible for any personal data breach which occurs as a result of:

  1. a) an event which is beyond our control;
  2. b) an act or threats of terrorism;
  3. c) an act of God (such as, but not limited to pandemics, fires, explosions, earthquakes, drought, tidal waves and floods);
  4. d) war, hostilities (whether war be declared or not), invasion, act of foreign enemies, mobilisation, requisition, or embargo;
  5. e) rebellion, revolution, insurrection, or military or usurped power, or civil war which compromises our data protection measures;
  6. f) the transfer of your personal information to a third party on your instructions; and
  7. g) the use of your personal information by a third party designated by you.

8. Data Security

 TUSEN takes all necessary technical and organizational measures to protect the confidentiality and security of your personal information collected through our Media to ensure the security of personal information is guaranteed.

9. Principles for Processing of Personal Data

TUSEN shall when collecting and processing personal information, ensure full compliance to the principles under the NDPR.  We shall ensure that:

  1. your personal information is processed in a lawful, fair and transparent manner;
  2. your personal information in our possession is accurate and up-to-date;
  3. personal information is processed for specific and identified purpose;
  4. the collection of your personal information is limited to necessary and relevant personal information;
  5. the confidentiality and integrity of your personal information is maintained;
  6. your personal information is stored and retained in line with the requirements of law, regulation, contract or purpose of collection; and
  7. accountability of your personal information is assured by continuously monitoring and improving its privacy and security practices.

  • Develop transparent data collection procedures
  • Train employees in online privacy and security measures
  • Build secure networks to protect online data from cyberattacks
  • Establish clear procedures for reporting privacy breaches or data misuse
  • Include contract clauses or communicate statements on how we handle data
  • Establish data protection practices (document shredding, secure locks, data encryption, frequent backups, access authorization etc.)
